These Terms of Use are an agreement between you and ZIVKA ZIZICA BB ("we", "us") governing your use of this iOS app and everything in it. By downloading, installing or using the app you accept these terms. If you do not accept them, do not use the app.
Our handling of information is described separately in the Privacy Policy, which forms part of this agreement.
The app is rated for general audiences but is intended for adults who care for a cat. You must be at least 13 years old, or the minimum age required in your country, to use it. If you are under the age of majority where you live, you may use the app only with the involvement of a parent or guardian, who accepts these terms on your behalf. A purchase must be made by someone legally able to enter into a contract.
The app lets you record the sounds your cat makes, or import an existing recording or video, and analyses the sound on your device to suggest what kind of sound it is. Over time it builds a personal dictionary for your cat, keeps a diary and activity history, shows trends, provides written care guides, and can schedule local reminders. Your cat's profile, photo, recordings and history are stored on your device.
The app is entertainment and general information, not a diagnostic or veterinary tool. The sound classification is a statistical estimate and is frequently wrong. Nothing in the app tells you what your cat is thinking, what your cat is saying in words, or whether your cat is unwell. Never use it to make a decision about your animal's health. If you are worried about your cat, consult a qualified veterinarian.
We may revise these terms when the app or the applicable law changes. The date at the top shows the current version. If you keep using the app after a revision takes effect, you accept the revised terms; if you do not accept them, stop using the app and cancel any subscription.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the app on Apple-branded devices you own or control, for your own non-commercial purposes, in accordance with the App Store Terms of Service.
You may not: copy, sell, rent, sublicense or otherwise distribute the app; modify, translate, decompile, disassemble or reverse-engineer it, or attempt to derive its source code or models, except to the extent this restriction is prohibited by law; remove or alter any proprietary notice; use the app or its content to build a competing product; or scrape, extract or bulk-collect content from it by automated means.
The app, its source code, sound-analysis models, interface, illustrations, guide texts, sounds and branding are owned by us or our licensors and are protected by copyright and other laws. These terms grant you a licence to use the app, not any ownership of it. Third-party materials referenced in the guides remain the property of their respective owners.
Recordings, photos, cat profiles, labels, notes and diary entries you create in the app are yours. They stay on your device: we do not upload, host, review or moderate them, and we obtain no licence to them. You are responsible for what you record and for having the right to record it, and for keeping your own backups. If you delete the app or clear your history, that content is gone and we cannot restore it.
You agree not to use the app to break the law, infringe anyone's rights, record people without the consent required where you live, interfere with the app's operation or security, circumvent subscription controls or usage limits, or misrepresent the app's output as veterinary, medical or professional advice to others.
The app can be used for free with limits: a limited number of microphone recordings and imports, and access to one care guide. An optional auto-renewing subscription lifts those limits and unlocks the full set of guides and themes.
We do not collect or process your payment details; we receive only the confirmation from Apple that a subscription is active. Prices and plans may change; a change to an existing subscription takes effect only for future periods and, where Apple requires it, only with your agreement.
The app uses AppsFlyer and Google Firebase for attribution and analytics, and Apple's App Store for purchases, as described in the Privacy Policy. The care guides cite external organisations and may link to their websites. We do not control those services or sites and are not responsible for their content, availability or practices.
The app depends on your device, its operating system and, for some functions such as purchases and restoring, on a network connection and on Apple's services. We may change, suspend or discontinue features, or stop supporting older iOS versions or devices, and we do not guarantee uninterrupted or error-free operation. The accuracy of the sound analysis depends on the recording conditions and on how much you have recorded, and will vary between cats.
To the fullest extent permitted by law, the app is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app's interpretations of your cat's sounds are correct, or that the app will meet your expectations. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of data, content or profits, arising from or connected with your use of the app - including any decision you take about your animal based on what the app shows. Our total liability for any claim relating to the app is limited to the amount you paid us for it in the twelve months before the event giving rise to the claim. Nothing here limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. Your statutory consumer rights are unaffected.
You are responsible for complying with the laws that apply to you when using the app, including any local rules on recording sound. The app may not be used where its use would be unlawful, or by anyone barred from receiving it under applicable export control or sanctions rules.
You may end this agreement at any time by cancelling your subscription and deleting the app. We may suspend or terminate your licence if you breach these terms or use the app unlawfully. Termination does not by itself entitle you to a refund of amounts already paid; sections that by their nature should survive - intellectual property, disclaimers, limitation of liability and governing law - continue to apply.
This agreement is governed by applicable law, and by any mandatory consumer protection rules of the country where you habitually reside, which these terms do not override. If a dispute arises, please contact us first at support@terrionre.com - most matters are resolved that way. Disputes that cannot be settled informally shall be brought before the courts having jurisdiction under the applicable law.
If any provision of these terms is held invalid or unenforceable, it will be limited or removed to the minimum extent necessary and the rest remains in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the app. You may not assign this agreement; we may assign it in connection with a transfer of our business.
